Overview

Welcome to Ryujin Hobbies. The terms "we", "us" and "our" refer to Ryujin Hobbies, with a store at 1-10 Prescott St, Kemptville, Ontario. Ryujin Hobbies operates this store and website, including all related information, content, features, tools, products and services (the "Services"). Ryujin Hobbies is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced here (the "Terms"), describe your rights and responsibilities when you use the Services. Please read them carefully — they include important information about your legal rights, including warranty disclaimers and limits on liability. By visiting, interacting with or using our Services, or by shopping in our store or attending our events, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Services.

1. Access and account

By agreeing to these Terms, you represent that you are at least the age of majority in your province of residence, and that you have given consent for any minor dependents to use the Services on devices you own or manage. You are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell or assign your account.

2. Our products

We make every effort to represent our products accurately. Colours and appearance may differ on your screen. Descriptions are subject to change without notice, and we may discontinue products or limit quantities at any time. Trading card singles are graded to the TCGplayer condition standard as described in our Card Condition Guide; graded cards are sold as certified by the grading company named in the listing, and we make no representation beyond that certification.

3. Orders

When you place an order you are making an offer to purchase. We may accept or decline any order at our discretion and an order is not accepted until we confirm it. We must receive and process payment before an order is accepted. Purchases are subject to return or exchange only in accordance with our Refund Policy. We may limit quantities per customer on limited-allocation product and may cancel orders that appear to be for commercial resale.

4. Prices and billing

Prices, discounts and promotions are subject to change without notice. The price charged is the price in effect when the order is placed, as shown in your order confirmation. Unless stated, prices exclude taxes, shipping, handling, customs and import charges, except for orders shipped to the United States, where prices are shown in US dollars and include duties and import taxes calculated at checkout as described in our Shipping Policy. Online prices may differ from in-store prices. You agree to provide current, complete and accurate purchase and payment information and that you are authorized to use the payment method provided.

5. Pre-orders

Pre-orders are charged at the time of order to secure your allocation. Release dates are set by publishers and may change; we are not liable for publisher delays or allocation cuts, but if we cannot fill your pre-order we will refund it in full. Our Pre-Order Price Protection applies as described on that page. Cancellation rights are set out in the Refund Policy.

6. In-store shopping and events

Event bookings purchased online or in store are subject to the event's posted entry fee, seat limit, format and prize support. Players must follow the rules of the game's publisher and our house rules; we may refuse entry or remove any participant for cheating, theft, harassment or unsafe behaviour without refund. Minors are welcome at events unless the event page says otherwise; a parent or guardian is responsible for them while in the store. We may photograph events for our social media — tell a staff member if you'd prefer not to be photographed. Personal property, including decks and collections, remains your responsibility while in our store.

7. Ryujin Points

Ryujin Points is our rewards program: points are earned on eligible purchases in store and online at the rate shown on our website and may be redeemed for store credit in the increments we publish. Points have no cash value, are not transferable, are reversed when an order is refunded, and may be adjusted if earned in error. We may change or end the program, or the earning and redemption rates, at any time; we will give reasonable notice of material changes. Store credit and gift cards have no cash value and cannot be redeemed for cash except where required by law.

8. Buylist

Buylist offers are quotes based on the condition you select and current market pricing; the final offer is confirmed when we inspect the cards. You represent that you own the cards you sell to us and have the right to sell them. Payouts are issued as store credit unless we say otherwise at the time. Cards mailed to us are your responsibility until we receive them; use a tracked service.

9. Shipping and delivery

Delivery times are estimates only. We are not responsible for delays caused by carriers, customs or events outside our control. Once we transfer products to the carrier, title and risk of loss pass to you. Our Shipping Policy applies to every shipped order.

10. Intellectual property

The Services, including trademarks, text, images, graphics, design and arrangement, are owned by Ryujin Hobbies, its licensors, or the respective game publishers, and are protected by Canadian and international copyright, trademark and other intellectual property laws. You may use the Services for personal, non-commercial purposes only. Game names, card images and logos belong to their publishers and are used for identification only.

11. Optional tools and third-party links

Third-party tools and links are provided "as is" without warranty or endorsement. Your use of them is at your own risk and subject to the third party's terms.

12. Relationship with Shopify

Sales are made directly with Ryujin Hobbies. Shopify is not responsible for any aspect of a sale between you and us, and you release Shopify and its affiliates from claims arising from your purchases with us.

13. Privacy

Personal information collected through the Services is subject to our Privacy Policy; some information is also subject to Shopify's Privacy Policy.

14. Feedback

If you submit feedback, reviews or other content, you grant us a perpetual, worldwide, royalty-free licence to use it, and you confirm you have the rights to it and that it is lawful and accurate. We may remove content at our discretion.

15. Errors, inaccuracies and omissions

Occasionally there may be typographical errors or inaccuracies in product descriptions, pricing, promotions or availability. We may correct errors and change or cancel orders affected by them, including after you have submitted an order, and will refund any amount paid for a cancelled order.

16. Prohibited uses

You may use the Services only for lawful purposes. You may not use the Services to break any law, infringe intellectual property, harass anyone, transmit false information or malicious code, scrape or bulk-collect data, or interfere with the Services' security. We may suspend or terminate access for violations.

17. Termination

We may terminate this agreement or your access to the Services at any time without notice; you remain liable for amounts due up to termination. Provisions that by their nature should survive termination will survive.

18. Disclaimer of warranties

Except as expressly stated by Ryujin Hobbies, the Services and all products are provided "as is" and "as available" without any representation, warranty or condition of any kind, express or implied, including merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement, to the fullest extent permitted by law. Nothing in these Terms limits rights you have under the Ontario Consumer Protection Act, 2002 or other applicable consumer law.

19. Limitation of liability

To the fullest extent permitted by law, Ryujin Hobbies, its directors, employees, contractors, service providers and licensors, and Shopify and its affiliates, are not liable for any indirect, incidental, special, punitive or consequential damages, including lost profits, arising from your use of the Services or any product, whether in contract, tort (including negligence) or otherwise. Our total liability for any claim relating to a purchase is limited to the amount you paid for that purchase.

20. Indemnification

You agree to indemnify and hold harmless Ryujin Hobbies, Shopify and their affiliates, officers, employees and service providers from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, your violation of any law or third-party right, or your use of the Services.

21. Severability, waiver, entire agreement, assignment

If any provision of these Terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. These Terms and the policies posted on the Services are the entire agreement between you and us and replace prior agreements. You may not assign these Terms without our written consent; we may assign them without notice.

22. Governing law

These Terms and any purchase from us are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. You and Ryujin Hobbies agree to the exclusive jurisdiction of the courts of Ontario, except that you may bring a claim in your local small claims court where the law allows.

23. Changes to these Terms

We may update these Terms by posting changes on this page; material changes take effect on the date stated in the notice. Your continued use of the Services after changes are posted means you accept them.
